Beta Tester Confidentiality Agreement (NDA)
Effective July 14, 2026 -- Between Kuper Bank ("Company") and the Tester who agrees below
This Confidentiality Agreement ("Agreement") is between Kuper Bank, operator of the DickTacToe app ("Company," "we," "us"), and the individual who agrees below ("Tester," "you"). By signing up as a beta tester, you agree to keep confidential anything you see, use, or learn while testing DickTacToe before it is publicly released.
1. What this covers. As a beta tester you may get early access to DickTacToe on TestFlight (iOS) or Google Play closed testing (Android) before it is available to the public. "Confidential Information" means anything related to the unreleased app that is not already public, including: unreleased features, screens, designs, and app behavior; bugs, crashes, security issues, or other vulnerabilities you find; screenshots, screen recordings, or video of the app; TestFlight/Play Console invite links, build files, or install instructions; and any feedback exchanged about the app's roadmap or business plans.
2. What you agree to do. Don't post, share, or publish screenshots, video, or descriptions of the app publicly (social media, forums, app-review sites, etc.) before it launches. Don't share your invite link, build, or install access with anyone else. Report bugs and security issues privately to support@dick-tac-toe.com instead of disclosing them publicly. Don't reverse-engineer, decompile, or attempt to extract source code or backend data beyond normal use of the app. Use the reasonable care you would use to protect your own confidential information.
3. What's not covered. This Agreement does not restrict information that is already public through no fault of yours, that you already knew before testing, or that you independently develop without using our Confidential Information. Once DickTacToe is publicly released, the released features stop being confidential -- anything not made public stays covered.
4. Feedback. Any feedback, bug reports, or suggestions you give us are ours to use, modify, and act on however we would like, without owing you compensation or credit.
5. No compensation, no employment. Beta testing is voluntary and unpaid. Agreeing to this does not make you an employee, contractor, or agent of Kuper Bank, and does not guarantee continued access to the app.
6. Term. Your confidentiality obligations start when you agree and continue until the relevant information becomes public (e.g. DickTacToe's public launch), or for 12 months, whichever is later.
7. Ending your access. We can remove your tester access at any time, for any reason. Your confidentiality obligations survive after your access ends.
8. Governing law. This Agreement is governed by the laws of the State of California, without regard to conflict-of-law principles.

Emailing or submitting the signup form after reading this page counts as your signature and agreement to these terms.
